If you are planning a single-storey rear extension, loft conversion, or garden room, there is a good chance your build falls under Permitted Development (PD)—meaning you don't need to go through full planning permission.
However, "not needing planning permission" is not the same as having legal proof.
This is where a Lawful Development Certificate (LDC) comes in. Whether you are building in Barnet, Brookmans Park, St Albans, or across North London, an LDC is your single most important legal safeguard.
What Exactly Is a Lawful Development Certificate?
An LDC (specifically a Certificate of Lawfulness of Proposed Use or Development) is a formal, legally binding document issued by your Local Planning Authority (LPA).
It provides written confirmation that your proposed construction project meets the statutory Permitted Development parameters and is lawful without full planning consent.
Why Do You Need an LDC If You Have Permitted Development Rights?
Technically, applying for an LDC is optional—you could build under Permitted Development without one. But in reality, skipping it is a real gamble for three reasons:
1. Future Conveyancing & Selling Your Home
When you eventually sell or remortgage your property, the buyer's solicitor will ask for proof of planning approval. If you built under Permitted Development without an LDC, you have no local council document proving the build is legal. This routinely stalls sales, forces homeowners to purchase indemnity policies, or delays completions.
2. Protection from Council Enforcement
Permitted development rules are strict. If your roof ridge is 10cm too high, your materials don't match, or a prior owner already used up the property's Permitted Development allowance years ago, your council could serve an enforcement notice requiring you to alter or remove the build. An LDC settles this before ground is broken.

3. Peace of Mind During the Build
Neighbours frequently call the local council when they see scaffolding and skips arrive. With a granted LDC in hand, you have clear legal proof that your build is compliant — provided it is built to the approved drawings.
How Much Does an LDC Cost in the UK?
- Council statutory fee: for proposed works, the fee is half of the equivalent full planning application fee. Fees are set nationally and change periodically, so check the current figure on the Planning Portal fee calculator before you apply.
- Architectural & submission costs: professional floor plans, elevations, block plans and application handling typically range between £500–£1,200 if arranged alongside your build tender. Indicative figures only, excluding VAT.
How Long Does an LDC Take to Be Approved?
Once submitted via the Planning Portal to your local authority (such as Barnet, Enfield, Hertsmere, or St Albans City and District Council), the statutory determination period is 8 weeks.
During this window, a planning officer verifies the drawings against national Permitted Development criteria and checks the property history (for example, ensuring Article 4 directions don't apply).
Does an LDC Replace Building Regulations?
No. This is the most common misunderstanding among homeowners.
- LDC / Planning: deals with whether you are legally permitted to build the structure on your land.
- Building Regulations: deals with structural integrity, foundations, fire safety, insulation, and drainage.
Even with a granted LDC, your build still requires Building Regulations approval and sign-off from a registered Building Control inspector.
Should You Apply Before Starting Work?
Yes, absolutely. Never begin digging foundations or knocking through load-bearing walls until your LDC has been granted. If your application is refused due to a technicality, you can tweak the architectural drawings without having to demolish completed brickwork.
